General Provisions<\/p>\n<p>1. SIA LINGUA FRANCA, Registration No. 40003596179, registered office at Ausek\u013ca iela 32, Valmiera, Valmiera Municipality, LV-4201 (hereinafter also referred to as the \u201cData Controller\u201d), collects, processes and stores personal data obtained from its Clients.<\/p>\n<p>2. When processing personal data, SIA LINGUA FRANCA complies with Regulation (EU) 2016\/679 of the European Parliament and of the Council of 27 April 2016 (the General Data Protection Regulation or \u201cGDPR\u201d) on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, the Personal Data Processing Law of the Republic of Latvia, and other applicable laws and regulations of the Republic of Latvia.<\/p>\n<p>3. The protection of user privacy and the secure and confidential processing of personal data are fundamental principles of this Privacy and Personal Data Protection Policy.<\/p>\n<p>4. For the purposes of this Policy, personal data means any information relating to an identified or identifiable natural person (the \u201cData Subject\u201d). Processing means any operation or set of operations performed on personal data, whether by automated means or otherwise, including collection, recording, organisation, storage, alteration, retrieval, consultation, use, disclosure, transmission, dissemination, restriction, erasure or destruction.<\/p>\n<p>5. The purpose of this Privacy Policy is to provide a general overview of the personal data processing activities carried out by SIA LINGUA FRANCA and the purposes for which personal data is processed.<\/p>\n<p>II. Collection, Processing and Storage of Personal Data<\/p>\n<p>6. SIA LINGUA FRANCA processes personal data responsibly, observes confidentiality requirements and takes appropriate measures to protect the security of personal data in its possession, while ensuring the provision of high-quality services throughout the period of cooperation with the Client.<\/p>\n<p>6.1. The Data Controller may obtain personal identification and other relevant information when Clients:<\/p>\n<p>6.1.1. Apply for SIA LINGUA FRANCA services remotely or at the company&#8217;s premises;<\/p>\n<p>6.1.2. Enter into a cooperation or service agreement;<\/p>\n<p>6.1.3. Subscribe to receive news, special offers and information about other services from SIA LINGUA FRANCA;<\/p>\n<p>6.1.4. Visit or use the SIA LINGUA FRANCA website;<\/p>\n<p>6.1.5. Are registered in the State Education Information System or another legally applicable education information system.<\/p>\n<p>7. SIA LINGUA FRANCA processes Clients&#8217; personal data for as long as at least one of the following criteria applies:<\/p>\n<p>7.1. A valid agreement or other contractual relationship exists between the Client and SIA LINGUA FRANCA;<\/p>\n<p>7.2. The retention period for the relevant personal data is established or required by the laws and regulations of the Republic of Latvia or the European Union;<\/p>\n<p>7.3. The Client&#8217;s consent remains valid where consent is the legal basis for the relevant processing and has not been withdrawn;<\/p>\n<p>7.4. To the extent necessary to provide high-quality services and fulfil its contractual or legal obligations, SIA LINGUA FRANCA may disclose or share personal data:<\/p>\n<p>7.4.1. With institutions, teachers, service providers and cooperation partners involved in fulfilling the Client&#8217;s order or providing the requested service, where such disclosure is lawful and necessary;<\/p>\n<p>7.4.2. With debt collection companies or other organizations involved in the lawful recovery of outstanding debts, where necessary and permitted by law.<\/p>\n<p>8. By using the services offered by SIA LINGUA FRANCA, the Client acknowledges that personal data provided by the Client may be processed in accordance with the purposes and legal bases described in this Privacy and Personal Data Protection Policy.<\/p>\n<p>9. The Client is responsible for ensuring that the personal data provided to SIA LINGUA FRANCA is accurate, complete and up to date. Knowingly providing false information may constitute a breach of this Privacy Policy and may have other legal consequences. The Client should promptly notify the Data Controller of any changes to the personal data previously provided.<\/p>\n<p>10. SIA LINGUA FRANCA may disclose or provide information concerning personal data where required or permitted by applicable law:<\/p>\n<p>10.1. Upon a lawful request from state authorities, courts or law enforcement authorities, including where necessary to protect or exercise the company&#8217;s legal rights and legitimate interests, including the preparation, submission or defence of legal claims;<\/p>\n<p>10.2. Personal data will be disclosed only to the extent necessary and proportionate to the relevant legal requirement or circumstances of the particular case;<\/p>\n<p>10.3. The Data Controller shall not be responsible for losses suffered by the Client or third parties to the extent such losses result from inaccurate, incomplete or false personal data provided by the Client, except where otherwise required by applicable law.<\/p>\n<p>III. Processing of Clients&#8217; Personal Data<\/p>\n<p>11. Depending on the services provided and the applicable purposes of processing, the Data Controller may process the following categories of personal data:<\/p>\n<p>11.1. Personal identification data \u2013 first name, surname, personal identification number and residential address, where required and lawful;<\/p>\n<p>11.2. Contact information \u2013 email address, telephone number and username or other identification information used to access online teaching platforms such as Microsoft Teams;<\/p>\n<p>11.3. Service-related data \u2013 name of the service, service cost, discounts, selected language, language level assessment results and examination results;<\/p>\n<p>11.4. Payment and accounting data \u2013 invoices, invoice amounts, dates and number of lessons;<\/p>\n<p>11.5. Teacher information \u2013 information contained in a teacher&#8217;s CV and other professional information relevant to the provision of educational services;<\/p>\n<p>11.6. Photographs and videos of teachers, where collected and processed on an appropriate legal basis;<\/p>\n<p>11.7. Other information voluntarily provided to SIA LINGUA FRANCA when purchasing services through the website or when otherwise communicating with the company, to the extent such information is relevant and necessary for the applicable purpose.<\/p>\n<p>12. In addition to the above, the Data Controller may verify the accuracy of information provided by a Client using publicly available registers and other lawful sources, where necessary and permitted by applicable law.<\/p>\n<p>13. SIA LINGUA FRANCA protects Clients&#8217; personal data by implementing appropriate organizational, technical and other measures proportionate to the risks associated with personal data processing and taking into account the state of available technology.<\/p>\n<p>14. The legal bases for processing personal data may include the following grounds set out in Article 6(1) of the GDPR:<\/p>\n<p>14.1. Point (a) \u2013 Consent: the Data Subject has given consent to the processing of their personal data for one or more specific purposes;<\/p>\n<p>14.2. Point (b) \u2013 Contract: processing is necessary for the performance of a contract to which the Data Subject is a party, or in order to take steps at the request of the Data Subject prior to entering into a contract;<\/p>\n<p>14.3. Point (c) \u2013 Legal obligation: processing is necessary for compliance with a legal obligation to which the Data Controller is subject;<\/p>\n<p>14.4. Point (f) \u2013 Legitimate interests: processing is necessary for the purposes of the legitimate interests pursued by the Data Controller or a third party, except where such interests are overridden by the interests or fundamental rights and freedoms of the Data Subject requiring protection of personal data, particularly where the Data Subject is a child.<\/p>\n<p>15. The Data Controller stores and processes Clients&#8217; personal data for as long as at least one of the following criteria applies:<\/p>\n<p>15.1. The personal data remains necessary for the purposes for which it was collected;<\/p>\n<p>15.2. The Data Controller and\/or the Client may exercise or defend legitimate interests in accordance with applicable laws and regulations, including submitting objections or bringing, pursuing or defending a legal claim;<\/p>\n<p>15.3. There is a legal obligation to retain the data, including obligations arising under applicable accounting, tax or other legislation;<\/p>\n<p>15.4. The Client&#8217;s consent to the relevant processing remains valid, where consent is the applicable legal basis and no other lawful basis for processing applies.<\/p>\n<p>16. When the applicable retention period expires and there is no other lawful basis or legal requirement to retain the personal data, the relevant personal data will be securely deleted or otherwise disposed of. Where appropriate, electronic and paper records containing personal data will be securely destroyed or the personal data will be anonymized so that the Data Subject can no longer be identified.<\/p>\n<p>17. In order to fulfil its obligations towards Clients, the Data Controller may engage third-party data processors to process personal data on its behalf, where such processing is necessary for the provision of services. Examples may include IT service providers, hosting providers, payment service providers, courier services and other service providers.<\/p>\n<p>Such processors may process personal data only in accordance with the Data Controller&#8217;s documented instructions and applicable data protection requirements. Where required by the GDPR, the relationship between the Data Controller and a data processor will be governed by an appropriate data processing agreement or other legally binding arrangement.<\/p>\n<p>18. When processing and storing personal data, the Data Controller implements appropriate organizational and technical measures designed to protect personal data against accidental or unlawful destruction, loss, alteration, unauthorized disclosure, unauthorized access and other unlawful or unauthorized forms of processing.<\/p>\n<p>IV. Rights of the Data Subject<\/p>\n<p>19. In accordance with the GDPR and the laws and regulations of the Republic of Latvia, the Data Subject has the following rights, subject to the conditions and limitations established by applicable law:<\/p>\n<p>19.1. Right of access and data portability: to obtain access to their personal data and information concerning its processing and, where the conditions of Article 20 of the GDPR are met, to receive personal data provided to the Data Controller in a structured, commonly used and machine-readable format and, where technically feasible and legally applicable, request that such data be transmitted to another data controller;<\/p>\n<p>19.2. Right to rectification: to request the correction of inaccurate or incomplete personal data;<\/p>\n<p>19.3. Right to erasure (\u201cright to be forgotten\u201d): to request the deletion of their personal data where one of the grounds established by the GDPR applies, subject to circumstances in which the Data Controller is legally required or otherwise entitled to retain the data;<\/p>\n<p>19.4. Right to withdraw consent: to withdraw consent to the processing of personal data at any time where processing is based on consent. Withdrawal of consent does not affect the lawfulness of processing carried out before consent was withdrawn;<\/p>\n<p>19.5. Right to restriction of processing: to request restriction of the processing of their personal data in circumstances specified by the GDPR, including where the accuracy of the data is contested, the processing is unlawful, the Data Controller no longer needs the data but the Data Subject requires it for the establishment, exercise or defence of legal claims, or where the Data Subject has objected to processing pending verification of the relevant grounds;<\/p>\n<p>19.6. Right to lodge a complaint with the supervisory authority: to lodge a complaint with the Data State Inspectorate of Latvia (www.dvi.gov.lv) if the Data Subject considers that the processing of their personal data infringes the GDPR or other applicable data protection legislation.<\/p>\n<p>19.7.
